12-Year Limited Warranty Terms

1. Warranty Coverage
1.1 Scope
Nordic Offsite Limited (“the Manufacturer”) provides a limited warranty (“the Warranty”) solely for the structural integrity of its prefabricated bathroom pods (“the Product”) against defects in materials and workmanship arising from normal, approved use for a period of twelve (12) years from the date of delivery to the original purchaser (“the Client”).
1.2 Structural Integrity Only
Coverage is strictly limited to defects that render the main load-bearing structure or framework of the Product unsound under normal use. Any other component, part, finish, or fixture—including those supplied or recommended by the Manufacturer—is expressly excluded unless otherwise specified below.
1.3 Non-Transferability
This Warranty is extended exclusively to the original Client and cannot be assigned or transferred in any manner to subsequent owners or any other party.
2. Warranty Exclusions
This Warranty does NOT cover, and shall be deemed void if any of the following applies:
2.1 Normal Wear and Tear
Gradual deterioration or cosmetic issues, such as discoloration, scratches, corrosion, fading, or surface blemishes, even if they result in functional impairment over time.
2.2 Improper Use, Installation, or Modification
Installation, assembly, or modification not in strict compliance with the Manufacturer’s guidelines.
Use of unapproved parts, materials, adhesives, or methods.
Any alteration or tampering by third parties or the Client without the Manufacturer’s prior written consent.
Building movement, settlement, or structural deficiencies external to the Product that cause or contribute to damage.
2.3 Non-Compliance with Maintenance Requirements
Any damage or defect arising from the Client’s failure to follow the Manufacturer’s written maintenance schedule (see Section 4).
Insufficient or missing maintenance documentation or records will automatically void coverage.
2.4 Water Ingress, Leaks, and Moisture
Any water damage, damp, mold, or related issues unless the Client can definitively prove the damage is caused by a structural defect inherent in the Product.
Ingress from plumbing systems, surrounding construction, or other building elements is excluded from coverage.
2.5 External Factors
Damage or defects caused by acts of nature (e.g., flooding, storms, earthquakes, lightning), extreme temperatures, or excessive humidity.
Use of improper cleaning agents, harsh chemicals, high-pressure washing, or abrasive materials.
Accidental or intentional damage, misuse, negligence, vandalism, or any impact from third parties.
2.6 Third-Party Components & Fixtures
Any defect, failure, or malfunction of parts not manufactured by Nordic Offsite Limited, such as taps, mixers, showerheads, waste pipes, toilets, lighting, ventilation fans, electrical components, or adhesives/sealants. These are governed exclusively by the original component manufacturers’ warranties.
The Manufacturer does not assume responsibility for coverage, labor, or claim resolution on third-party warranties.
2.7 Labour, Transport, and Associated Costs
Costs related to removal, reinstallation, transport, inspection, labor, scaffolding, disposal, lost time, temporary facilities, or any disruption to building operations.
Indirect costs such as loss of profit, business interruption, personal inconvenience, or property damage are explicitly excluded.
3. Specific Component Warranties
3.1 Third-Party Warranties
To the extent that any fixtures, fittings, or components are supplied or recommended by the Manufacturer but not manufactured by the Manufacturer, they carry only the original manufacturer’s warranty, if any, and for the duration stated therein. Illustrative periods (subject to each third-party’s terms) include:
Plumbing fixtures (toilets, taps, showers): 2 years
Electrical components (lighting, fans): 1 year
Silicone sealants and adhesives: 6 months
Decorative finishes (paints, tiles, panels): No warranty
3.2 Manufacturer Disclaimer
Claims arising from any such third-party component(s) must be directed exclusively to the original component manufacturer. Nordic Offsite Limited disclaims all liability arising from or relating to third-party warranties.
4. Maintenance Requirements
4.1 Mandatory Quarterly Inspections
The Client must conduct and document quarterly inspections of all seals, fittings, and structural elements. Failure to provide complete, dated, and verifiable inspection records upon request voids this Warranty.
4.2 Approved Service Providers
Any servicing or repairs must be completed by Manufacturer-approved professionals, using only Manufacturer-approved materials, tools, and methods. Unapproved maintenance or repair work immediately voids this Warranty.
4.3 Cleaning and Upkeep
Only cleaning agents and methods expressly authorized in writing by the Manufacturer may be used. Use of any unapproved cleaning product or abrasive technique voids coverage.
5. Warranty Claim Procedure
5.1 Timely Written Notice
The Client must submit a formal written claim (by recorded delivery or email with read receipt) to the Manufacturer within fourteen (14) days of discovering the alleged defect, and in no event later than the expiry of the 12-year Warranty period.
Failure to comply with this notice requirement bars any claim.
5.2 Proof & Documentation
All claims must include:
Photographic or video evidence clearly illustrating the alleged defect.
Detailed description of the circumstances under which the defect was noticed.
Complete maintenance records as stipulated in Section 4, demonstrating full compliance.
Proof that no unauthorized modifications or repairs have taken place.
5.3 Manufacturer’s Rights
The Manufacturer reserves the right to:
Conduct an on-site inspection or any technical tests deemed necessary to verify the alleged defect.
Determine, in its sole discretion, whether the claim qualifies under this Warranty.
Deny any claim where misuse, non-compliance, or third-party impact is suspected or if documentation is incomplete.
Repair the defective structural element as a first remedy; or, if the Manufacturer deems repair impractical, provide a replacement of the defective structural element.
If both repair and replacement are deemed not feasible, issue a pro-rated refund of the original purchase price for the specific defective structural element.
5.4 Final Determination
All assessments and decisions regarding claim validity, cause of defect, and appropriate remedy are final and binding on the Client.
6. Limitation of Liability
6.1 Exclusive Remedy
The sole and exclusive liability of the Manufacturer under this Warranty is limited to the repair, replacement, or pro-rated refund (at the Manufacturer’s option) of the specific defective structural element, subject to the terms herein.
6.2 Exclusion of Consequential Damages
Under no circumstances shall the Manufacturer be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of use, lost revenue or profits, business interruption, property damage beyond the Product itself, personal injury, or any other economic loss.
6.3 Maximum Liability Cap
In no event shall the Manufacturer’s aggregate liability exceed the original purchase price of the specific Product delivered to the Client under this Warranty.
6.4 Disclaimer of Other Warranties
Except as expressly stated herein, the Manufacturer disclaims all other warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or otherwise, to the fullest extent permissible by law.
6.5 Non-Transferability
This Warranty is personal to the original Client, and any transfer, assignment, or conveyance of the Product—whether by sale or otherwise—voids this Warranty in its entirety.
7. Governing Law & Dispute Resolution
7.1 Governing Law
This Warranty shall be governed by, and construed in accordance with, the laws of England and Wales (United Kingdom), without regard to conflict of law principles.
7.2 Exclusive Jurisdiction
All disputes arising out of or in connection with this Warranty shall be submitted to the exclusive jurisdiction of the courts of England and Wales, and the Client irrevocably submits to such jurisdiction.
7.3 Limitation of Actions
Any legal action relating to this Warranty must be commenced within one (1) year of the Manufacturer’s final written denial of a claim, failing which the action is barred.
8. Severability
If any provision of this Warranty is found invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it valid and enforceable.
9. Entire Agreement
This document constitutes the entire agreement between the Manufacturer and the Client regarding the Warranty. No oral representations, statements, or inducements by any party shall modify or supplement these terms unless made in writing and signed by an authorized representative of the Manufacturer.
By purchasing or accepting delivery of the Product, the Client acknowledges that they have read, understood, and agree to be bound by the above Limited Warranty Terms.
